These Terms of Use ("Terms") constitute a binding agreement between you and Beky Software ("the Company," "we," "us," or "our") governing your access to and use of this website and the services made available through it (collectively, the "Service"). By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference. If you do not agree to these Terms, you must not access or use the Service.
The Service is not directed to, and Accounts may not be created by, individuals under the age of 13. By creating an Account, you represent and warrant that you meet this age requirement and that you have the legal capacity to enter into these Terms.
To access certain features of the Service, you must register for an Account by providing a username, email address, and password. You agree to provide accurate information and to keep it up to date. You are solely responsible for maintaining the confidentiality of your password and for all activity that occurs under your Account. You agree to notify us promptly of any unauthorized use of your Account. We reserve the right to suspend or terminate an Account at our discretion, including where these Terms have been violated.
You retain ownership of any Content you submit through the Service. By submitting Content, you grant the Company a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that Content in connection with operating and promoting the Service. You represent and warrant that you own or otherwise have the necessary rights to submit the Content you provide, and that doing so does not infringe the intellectual property or other rights of any third party.
You acknowledge that certain features of the Service are, by design, intended to make Content publicly accessible. Approved reviews and photographs are displayed publicly and attributed to your username. Where you generate a shareable link for a saved-attraction folder, any person in possession of that link may view its contents, whether or not they hold an Account.
You agree not to use the Service to:
Reviews, photographs, and attraction requests submitted through the Service are subject to review prior to publication. We reserve the right, but assume no obligation, to review, approve, reject, or remove any Content at our sole discretion, including Content that has already been published, whether or not it violates these Terms.
The Company may, at its sole discretion, designate a User as the Owner of a specific Listing. Owner status grants limited management rights over that Listing's information, tags, links, and photographs, subject to the same content moderation rights described in Section 7 — Owner status does not extend to reviewing or moderating other Users' reviews or photographs, whether concerning that Listing or otherwise. The Company reserves the right to revoke Owner status at any time and for any reason, including where we are unable to verify a claimed association between a User and the attraction in question.
Listings, including addresses, coordinates, descriptions, and any warnings or notices displayed alongside them, are submitted and maintained by Users, Owners, and administrators, and may not always be accurate, complete, or current. Any warning or notice displayed on a Listing is provided as a courtesy and should not be relied upon as a complete or authoritative statement of conditions at that location. You are solely responsible for independently verifying any information before relying on it, including before visiting a physical location.
The Service, including its design, text, graphics, logos, and underlying software, is the property of the Company or its licensors and is protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.
The Service integrates with, or links to, services operated by third parties, including Google (Maps, reCAPTCHA, Analytics, and advertising products), OpenStreetMap, and Cloudinary. Your use of those services may be subject to their own separate terms, and we are not responsible for their content, availability, or practices.
The Service is provided "as is" and "as available," without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any Content, Listing, or information displayed through the Service is accurate, complete, or reliable.
To the fullest extent permitted by applicable law, the Company shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or goodwill, arising out of or in connection with your access to or use of, or inability to access or use, the Service, whether based on warranty, contract, tort, or any other legal theory, even if we have been advised of the possibility of such damages.
You agree to indemnify and hold the Company harmless from any claim, liability, damage, loss, or expense, including reasonable legal fees, arising out of or in connection with your Content, your use of the Service, or your violation of these Terms.
We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice. You may terminate your Account at any time through your account settings. Provisions of these Terms which by their nature should survive termination — including Sections 10, 12, 13, 14, 17, and 18 — shall survive any termination of your access to the Service.
We reserve the right to modify or discontinue the Service, in whole or in part, at any time. We may also amend these Terms at our discretion; the date at the top of this page indicates when they were last revised. Your continued use of the Service following any such amendment constitutes your acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g. "the State of Delaware, United States"], without regard to its conflict of law principles.
If any provision of these Terms is found by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable, such provision shall be modified to the minimum extent necessary to render it enforceable, or severed if it cannot be so modified, and the remaining provisions of these Terms shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding your use of the Service, and supersede any prior agreements between you and the Company on that subject.
